A new trial starts this week for a Manhattan man accused in the 2018 death of his former girlfriend’s 2-month-old son.

Jurors were selected Monday for the retrial of 24-year-old D’Khari Lyons, who is charged with first-degree murder in the death of Michael Calvert, Jr. The trial is expected to last five days.

According to evidence presented in the case, Lyons is accused of causing the death of Michael Calvert, Jr. in November 2018 while the mother stepped out to take her other children to school. A September trial ended with a hung jury after it failed to render a unanimous verdict. The child’s official cause of death was ruled to be blunt force or abusive head trauma after sustaining severe internal injuries.

Prosecutors have alleged Lyons lashed out at the child in frustration when he heard the child crying out. The defense has argued there was not enough evidence to prove Lyons was responsible for the child’s death.
